Theodore Chuang, US District Judge for the US District Court of the District of Maryland, presented a keynote speech about the Asian American experience at the 2018 Chinese American Convention, hosted in Washington DC by United Chinese Americans. Judge Chuang told how his parents immigrated to the US and how he got to where he is today. While it’s important for Chinese Americans to be involved in other fields, participating and supporting legal field is also important, such that we can support those who do not have access to justice, whether it be through finding attorneys or overcoming the language barrier.

Theodore D. Chuang serves as a United States District Judge for the District of Maryland and sits at the United States Courthouse in Greenbelt, Maryland. Judge Chuang was nominated by President Obama on September 25, 2013 and received his commission on May 2, 2014.
Prior to his appointment, Judge Chuang served as Deputy General Counsel of the U.S. Department of Homeland Security (DHS) from 2011 to 2014 and as Associate General Counsel of DHS from 2009 to 2011. In 2009, he served as Chief Investigative Counsel for the U.S. House of Representatives, Committee on Energy and Commerce. From 2007 to 2009, he served as Deputy Chief Investigative Counsel for the House Committee on Oversight and Government Reform. From 2004 to 2007, Judge Chuang was in private practice in Washington, D.C. at Wilmer Cutler Pickering Hale and Dorr, LLP.
From 1998 to 2004, Judge Chuang served as an Assistant United States Attorney in the Criminal Division of the U.S. Attorney’s Office for the District of Massachusetts. From 1995 to 1998, he served as a trial attorney at the U.S. Department of Justice, Civil Rights Division, in Washington, D.C. Judge Chuang began his legal career as a law clerk to Judge Dorothy W. Nelson of the U.S. Court of Appeals for the Ninth Circuit.
Throughout his career, Judge Chuang has been active in professional and community organizations. He has served as Chair of the Board of Directors of the Asian Pacific American Legal Resource Center, a legal services organization serving low income, limited English proficient Asian Americans and immigrants in Maryland and the Washington, D.C. region. He has also served on the Board of Governors of the District of Columbia Bar, as President of the Asian American Lawyers Association of Massachusetts, and as President-Elect of the Asian Pacific American Bar Association of the Greater Washington, D.C. Area.
Judge Chuang was born in Media, Pennsylvania and grew up in Lexington, Massachusetts. He graduated magna cum laude from Harvard Law School in 1994, where he was an Editor of the Harvard Law Review and a Finalist in the Ames Moot Court Competition, and received his B.A. summa cum laude in Economics from Harvard College in 1991.

州法院法官通常由选举产生不同,联邦法院的法官——包括最高法院的大法官们——是由美国总统提名,由参议院批准。所有的联邦法官都是终身制(这是由美国联邦宪法第三条“他们品行端正因而受任终身”所规定的)Theodore曾是美国国土安全部前副总法律顾问,他在2018美国华人大会上对大家说,今天美国800多个联邦法庭法官中,29是亚裔,华裔只有11华裔。“我一个从华人家庭走出来的小孩是如何成为地区法官的呢?”
Theodore说他的家庭犹如大多数华人家庭一样,父母早年来美国读书,后来经营一些小生意达到中产阶级,在教育上为小孩子们提供更好的机会。像大多数的华裔小孩子一样,他学习小提琴,很努力的读书,甚至被哈佛入取了。“但是在我大学的第一年我非常沮丧”他对爸妈说,他没有兴趣做医生或是工程师,他想成为一名律师。在那个年代,父母不觉得Theodore在这个领域会有竞争力,不论是语言、文化、或是其他方面我们亚裔都不占优势。可Theodore并不这么觉得,他可不是一个典型的华裔妈宝,他坚持选择上他喜欢的课程。在高中阶段,Theodore开始积极参与学生会工作,在大学阶段参加竞选,还在家乡政府拿到了两个职位。他积极的参与公共事务,在读完法学院之后,他代理了很多关于族裔歧视的案子,帮助非洲,亚裔,墨西哥等族裔移民成功打赢官司。
事业轨迹
1994年至1995年,Chuang开始担任美国第九巡回上诉法院法官Dorothy W. Nelson的法律助理。
1995年至1998年,他担任民权司的审判律师。
1998年到2004年,他在马萨诸塞州担任美国检察官助理。
2004年至2007年,他在华盛顿特区的Wilmer,Cutler,Pickering,Hale和Dorr LLP律师事务所担任法律顾问。
2007年至2009年,他担任众议院监督和政府改革委员会的副首席调查顾问。 2009年,他担任众议院能源和商业委员会的首席调查顾问。
2009年到2014年作为联邦法官确认,他担任美国国土安全部副总法律顾问。
联邦司法服务
2013年,Theodore David Chuang被美国总统·奥巴马提名,担任美国马里兰州地方法院法官。
2014Chuang的提名得到了马里兰州两位美国参议员Ben Cardin和Barbara Mikulski大力支持。
在美国历史上,司法体系是百姓保持平等公正最重要的保护伞,即便在政治体系无法保护个人利益的情况下。华裔了解、参与司法可以更好的维护自己的权利。从1983到2013间,法学院亚裔学生录取率飞快上升,目前法学院亚裔学生比例为7%,这个数字已经高于亚裔的人口比例;但是之后录取率下降了43%,这也直接影响到业界从业人员的数量。Theodore介绍说目前在全国范围内都有华人律师,很多人也在服务一些志愿者组织,帮助那些语言、文化有限的更有需要的人。他还提到,目前在最高级法院里的确还没有亚裔的影子,但是他相信那一天一定会来!在这个世界上,不是所有人都幸运生活在一个司法公正的社会环境里。相信每一个站在这片土地上的移民,都是因为相信这个国家的价值观:公平,自由,法律公正。正如很多年前,他问父亲为什么背井离乡来到美国,父亲回答只有两个字:“自由”!每个移民都有必要了解这个国家的司法体系,更好地捍卫自己的权利。
